The Family Conflict as a Human Problem and the Family Link to be Protected

In the field of Family Law, doctrine and regulatory development usually condition the judicial process in the specialty in a highly traditional perspective, which allows prolonging the dysfunctionality of family conflict in the judicial field. Thus, the development of the specialty does not allow us to address the family conflict from a human point of view, limiting itself to the exegetical and nineteenth-century analysis of the law that goes in the opposite direction to the development of society and the family. As a result, the parties fail to meet their needs, and a greater problem is generated by disengaging the parties that make up the family, affecting the family bond with problems that extend the family conflict.
